Approval based on the following findings: <br />A) The current pattern of docks on the west side with <br />parking only on the east, has existed for this marina <br />for over 30 years without mishap. <br />B) Based on County and City records there have been no <br />personal injury or property damage resulting from the <br />cross-over use of the clients of either Windward or <br />Minnetonka Boat Works. <br />C) Drainare/run-off will be improved by providing re­ <br />direction of surface run-off into retention pond for <br />treatment rather than draining directly into the lake. <br />As for conditions of approval, the appropriate conditions <br />set forth in Jacobs* memo of April 14, 1989 would be <br />included in an approval resolution, <br />be as follows: <br />Other conditions should <br />A) The cross-walk to be installed by the City at the <br />expense of Windward Marine and Minnetonka Boat Works <br />within shared property line areas of both marinas. <br />B) Appropriate signage to be provided by the County <br />with flashing yellow lights if County approves. City <br />staff to work with County regarding appropriate speed <br />limits for area if adjustment is deemed necessary. <br />C) Loading dock to be provided within east dock area <br />and to be designated on site plan. Such use to <br />commence this boating season. <br />D) Paving of parking area. At a minimum, the County <br />requests that the access area to the parking area be <br />paved. In the MCWD report. Exhibit V, there is no <br />notation of approval of a gravelled parking area. It <br />is staff's understanding that the MCWD intends to <br />approve gravelled parking areas because of greater <br />permeability of the surface. It has been the City's <br />practice to encourage paving where treatment facilities <br />are provided, lessening the silting problem. The City <br />granted Windward Marine special consideration because <br />of the storage of large boats and potential for <br />continuous damage to paving. The Smith Bay Marina has <br />been required to pave their parking area, again because <br />of the treatment facility. <br />E) Amend the landscape plan to provide replacement <br />trees. The current landscape plan shows no replacement <br />trees.
