Zoning File #1396 <br />May 4, 1989 <br />Page 2 of 6 <br />The Planning Commission members that supported a <br />recommendation for approval opined that the cross-walk would <br />address the safety concerns but felt that the cross-walk would <br />not be effective unless flashing lights were provided. The <br />practice and pattern of drivers using County Road 15, driving <br />usually above the allowed speeds, would require "mega" warnings. <br />Mere signage did not seem to answer that need. Members also <br />concurred that this is not a residential property but a <br />commercial B-2 property similar to all the other commercial <br />marinas with hardcover from parking areas located within the 0- <br />75* setback area noting the marina next door. <br />In approving the 3-year comprehensive plan for Windward <br />Marine, the City approved new hardcover for parking expansion <br />within the 0-75* setback area (review Exhibit X). In that review <br />a cross-walk was required. It should be noted that it was staff's <br />assumption that the County had failed to approve a cross-walk for <br />the Windward Marine area. In recent discussions with the County, <br />they advised that they had approved it but were awaiting the City <br />to install the cross-w^^ Ik. A single cross-walk shall be <br />installed within the area of the shared lot line of Windward <br />Marine and Minnetonka Boat Works providing safe trespass for <br />clients of the marinas. <br />Please review Exhibit Q, the al ernate parking plan <br />presented by the applicant in the early stages of the review. <br />The City Engineer and staff did meet out on the site a. i confirm <br />that approximately 14 parking stalls could be located on the west <br />side, not requiring excavation within the 75* setback area, but <br />would require major excavation of the existing bank adjacent to <br />the roadway and the removal of many trees. Staff advised the <br />applicant against presenting this as an alternative plan because <br />of the impact upon the neighbors to the sout!i who reside within <br />the residential Tanager Lake area. <br />Staff has received a complaint from a resident who resides <br />on the Tanager Lake side complaining of the impact of the dock <br />structures on the users of the lake. Reviewing the LMCD notices <br />and reports, similar complaints were noted at the meeting and <br />the docks were to be re-aligned to open up the channel area <br />(review Exhibit R - bearing notice and notification list). <br />It is staff's understanding that certain members of the <br />Tanager Lake community may appear at your meeting. Please note <br />the hearing notices were sent to all residents. It is also <br />staff's understanding that JoEllen Hurr will be present to <br />respond to any questions residents may have concerning the dock <br />arrangement. <br />&
