A RBSOLOnON 6RANTI116 <br />AH APTKR-THB-FACT <br />COHDITIOHAL USB PERMIT <br />PBR MUNICIPAL ZONING CODE <br />SECTION 10.03, SUBDIVIST'iN 19 <br />PILE #1392 <br />WHEREAS, Kim Edwards (hereinafter "the applicant") is <br />the owner of the property located at 2450 Woodhaven Drive located <br />within the City of Orono (hereinafter "City") and legally <br />described as follows: <br />Lot 2, BlocJc 1, Levering's Woodhaven, Hennepin County, <br />Minnesota (hereinafter "property"); and <br />WHEREAS, the applicant has applied to the City of Orono <br />for an after-the-fact conditional use permit to permit placement <br />of fill and grading in excess of 100 cubic yards per Municipal <br />Zoning Code Section 10.03, Subdivision 19. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #1392. <br />2. The property is located in the RR-IB Rural Residential <br />Zoning District. <br />3. On April 17, 1989, the Orono Planning Commission <br />reviewed the application and recommended approval, based on <br />the following findings: <br />A) The fill and grading that has ta)cen place will have <br />no significant impact on the neighboring properties and <br />will not change the rates or amounts of run-off. <br />B) The property was previously relatively low. The <br />average 4* depth of fill is not out of character with <br />the neighborhood. <br />C) No additional fill is proposed. <br />D) Applicant has agreed to finish grading per the City <br />Engineer's recommendation, and intends to landscape the <br />filled area. <br />Page 1 of 4
