Gaffron, Asst Planning & Zoning Administrator <br />Date: May 1989 <br />Subject: #1389 Mr. & Mrs. James Mardock, 880 Dakota Avenue - <br />Variance - Resolution <br />Zoning District - LR-lA, Single family, 2 acre, unsewered <br />Application - Request for after-the-fact variance to rebuild <br />upper level deck within required rear yard setback area. <br />List of Exhibits <br />Exhibit A - Notice of Planning Commission Action 4/18/89 <br />Exhibit B - Planning Commission Minutes 4/17/89 <br />Exhibit C - Proposed Resolution <br />Exhibit D - Memo & Exhibits 4/10/89 <br />Discussion - <br />Please review the memo and exhibits of April 10, 1989. <br />Briefly, the applicants replaced the pre-existing deck attached <br />to the rear of their house, not aware that a permit was required. <br />The new deck is in approximately the same location as the old <br />one, and is approximately the same size as the old one. <br />The deck is 27' from the rear lot line where a 50* setback <br />is required. Due to the site layout and nature of the <br />neighboring properties, none of the neighboring properties will <br />be affected by this deck. <br />Planning Commission, at their April 17th meeting, <br />recommended 6-0 to approve the after-the-fact variance. <br />II <br />Staff Recommendation - <br />Staff recommends approval per the attached resolution.
