AGENDA ITEM <br />Date: April 14, 2025 <br />Title: Cannabis Registration - Resolution 7575 <br />Presenter: Christine Lusian, City Clerk <br />Section: Consent Agenda <br />Purpose: <br />Delegate cannabis sales registration to Hennepin County <br />Item: 4 <br />2. Background: <br />The state's Office of Cannabis Management is responsible for licensing cannabis and hemp <br />businesses. Local units of governments (cities and counties) in Minnesota have various means of <br />oversight over the cannabis market, as provided by the adult -use cannabis law. Data collection, <br />research, collaboration and input from cities and community partners has gone into the process and <br />the development of a proposed ordinance by Hennepin County Public Health in collaboration with <br />County Administration and the County Attorney's Office. <br />Cities and counties must 1) establish a registration application and review process, including <br />specific bases for denial of registration; 2) certify that a proposed business complies with local <br />zoning and land use laws; and 3) conduct annual compliance checks of every cannabis and hemp <br />business for age -verification and compliance. <br />Cities and counties may 1) establish time, place and manner restrictions on businesses (e.g., hours <br />of operation); 2) limit the number of licensed cannabis retails to no fewer than one registration <br />per every 12,500 residents; 3) prohibit the operation of cannabis businesses within 1,000 feet of a <br />school or 500 feet of a daycare, residential treatment facility, or attraction within a public park that <br />is regularly used by minors; 4) cities within Hennepin County may defer their authority for <br />registration to Hennepin County at any time (Minn. Stat. § 342.22, subd. 1). <br />Orono adopted Ordinance 306 in October 2024 regulating cannabis business locations within the <br />city limits. Hennepin County is set up to process cannabis registrations and conduct compliance <br />inspections. With the adoption of the proposed resolution, a cannabis retailer would be licensed by <br />the state and registered with the county. <br />3.
