h ^:iLDTIOH 6RAHTING <br />A VARIANCE TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.22, SUBDIVISION 1 « 2 <br />AND SECTION 10.55, SUBDIVISION 8 <br />FILE #1382 <br />WHEREAS, John and Lois Rogers (hereinafter "the applicants") are <br />the owners of the property located at 755 Tonkawa Road within the City of <br />Orono (hereinafter "City") and legally described as follows: <br />Exhibit A, attached (hereinafter "the property"); and <br />WHEREAS, the applicants have applied to the City for variances to <br />Municipal Zoning Code Sections 10.22, Subdivisions 1 & 2 and 10.55, <br />Subdivision 8 to permit the construction of new structural hardcover in the <br />0“75' lakeshore setback zone where no structure or hardcover is normally <br />allowed, and a variance to allow encroachment past the average lakeshore <br />setback line where no encroachment is normally allowec. <br />Minnesota: <br />HOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. This application was reviewed as Zoning File #1382. <br />2. The property is located in the LR-IB Single Family Lakeshore <br />Residential Zoning District. <br />3. The Orono Planning Commission reviewed this application on <br />February 21, 1989, and recommended approval of the proposed variance <br />on a vote of 3 in favor, 2 against, based upon the following findings: <br />A) The proposed addition is almost entirely over an existing <br />patio hardcover area, hence the impact of new hardcover is <br />minimal. The applicant proposes to remove a long shed structure <br />near the lakeshore, resulting in an overall decrease in 0-75' <br />hardcover of 1 s.f. Hardcover in the 0-75' zone will not <br />increase above the existing 21.9% level. <br />B) The necessary variance for encroachir ,nt past the average <br />lakeshore setback line should be approved since no views enjoyed <br />by neighboring property owners will be affected by this <br />construction. <br />Page 1 of 4
