A) The proposed walkway structure is necessary to provide <br />reasonable access to the usable lakeshore without forcing the <br />property owner to cross the neighboring property. <br />B) The structure will maintain a low profile and is not intfjnded <br />to have a railing. <br />C) The 6* width, while 2' in excess of the 4* width normally <br />allowed for such structures, is necessary for the safety of the <br />users of such structure, considering the extremely long 175* <br />length of this walkway. <br />D) The structure at a 6* platform width comprises 1.8% hardcover <br />in the U-75* setback zone. There is no hardcover existing or <br />proposed in the 75-250* zone, fhe proposed walkway will have no <br />significant impact on run-off quantity or quality. <br />6. The City Council has reviewed the facts of the application and the <br />Planning Commission recommendation, and finds that the proposed 6 <br />platform width is excessive, and that a 4* wide walkway platform will <br />provide for adequate user safety while minimizing the impact or <br />hardcover in the 0-75* zone. Furthermore, although the applicant <br />wishes to avoid railings where possible, railings should be allowed <br />for safety purposes at any location on the structure where railings <br />are required by the Building Code. <br />7. The City Council finds that the conditions existing on this <br />property are peculiar to it and do not apply generally to other <br />property in this zoning district; that granting the variance would not <br />adversely affect traffic conditions, light, air nor pose a fire hazard <br />or other danger to neighboring properties; would not merely serve as a <br />convenience to the applicant, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to preserve a <br />substantial property right of the applicant; and would be in keeping <br />with the spirit and intent of the Zoning Code and Comprehensive Plan <br />of the City. <br />8. The City Council finds that granting a conditional use permit to <br />allow the construction of the proposed walkway with a platform width <br />not exceeding 4* would not be detrimental to the health, safety or <br />general welfare of the public, would not adversely affect light, a r <br />nor pose a fire hazard or other danger to neighboring properties, nor <br />will it depreciate surrounding property values and that the proposed <br />level of use of the property will be in keeping with the intent and <br />objectives of the Zoning Code and Comprehensive Plan of the City. <br />Page 2 of 5
