(Resolution #444, continued) - <br />Adopted by the Village Council of the Village of Orono, Minnesota, at a <br />regular meeting held. May 8, 1972. <br />Louis B. Martin, Clerk-ministrator <br />RESOLUTION #445 <br />A RESOLUTION ORDERING THE OWNERS OF A HAZARDOUS BUILDING <br />WITHIN THE VILLAGE OF ORONO TO CORRECT THE HAZARDOUS CONDITION <br />WHEREAS, James A. Christie is the record owner of certain real <br />property located at 584 Park Lane, within the Village of Orono, legally <br />described as follows: <br />Lots 1 and 2, Block 10; Minnetonka Summit Park, <br />according to the plat thereof on file or of record <br />in the office of the Register of Deeds in and for <br />said county. <br />WHEREAS, the building constructed on said real property is in <br />a dilapidated condition, has no water supply, has no sanitary facilities <br />and constitutes a health and fire hazard: <br />NOW, THEREFORE, BE IT RESOLVED, that pursuant to Minnesota <br />Statutes 463.1.6 the said James A. Christie is ordered to correct the <br />condition above described on the grounds that the condition is hazardous <br />within the meaning of Minnesota Statutes 463.15 through 463.26; and <br />BE IT FURTHER RESOLVED, that the said James A. Christie is <br />ordered to correct.the condition by razing the building.and filling in <br />the excavated area, or in the alternative, checking and rebuilding <br />as necessary the foundation, bearing walls and non-bearing walls, <br />replacing structural members which are weak, checking and replacing or <br />repairing the entire heating, electrical and plumbing systems as necessary <br />to bring them within the specifications of the Municipal Code of Orono, <br />and all window seals and doors should be repaired as necessary, and the <br />building should then be closed and secured or -occupied, within 45 days <br />from the date this order is duly served upon him; and <br />BE IT FURTHER RESOLVED, that a motion for summary enforcement <br />of this order be made to the District Court of Hennepin County, State <br />of Minnesota,:,:unless corrective action is taken by the -•said James A. <br />Christie or unless his answer is filed within the time specified in <br />Minnesota Statutes 463.18; and <br />BE IT FURTHER -RESOLVED, that the Village Administrator and <br />Village Attorney be, and hereby are, directed to prepare and serve this <br />order and take all other necessary action in accordance with this <br />resolution and in accordance with Minnesota Statutes 463.15 through <br />463.26. <br />
