r <br />RESOLUTION #441 <br />A RESOLUTION ORDERING THE OWNERS OF A HAZARDOUS BUILDING <br />WITHIN'THE VILLAGE OF ORONO TO CORRECT THE HAZARDOUS CONDITION <br />WHEREAS, Ronald L. and Jane C. Carrigan are the record owners <br />of certain real property located at 3950 North Shore Drive, within. the <br />Village of Orono, legally described as follows: <br />Lots 9 and 10, Hickory Hill Addition; <br />WHEREAS, the building constructed on said real property has <br />been approximately 75% destroyed by fire, has no water supply, has no <br />sanitary facilities and constitutes a health and fire hazard; <br />NOW, THEREFORE, BE IT RESOLVED, that pursuant to Minnesota <br />Statutes 463.16 the said Ronald L. and Jane C. Carrigan are ordered to <br />correct the condition above described on the.grounds that the condition <br />,is hazardous within the meaning of Minnesota Statutes 463.15 through <br />463.26; and <br />BE IT FURTHER RESOLVED, that the said Ronald L. and Jane C. <br />Carrigan are ordered to correct the condition by razing the building and <br />filling in the excavated.area, or in the alternative, checking and <br />rebuilding as necessar:4"the foundation, bearing walls and non-bearing <br />walls, replacing structural members which are weak, checking and replacing <br />or repairing the entire heating, electrical and plumbing systems as <br />necessary to bring them within the specifications of the Municipal Code <br />of Orono, and all window seals and doors should be repaired as necessary,. <br />and the building should then be closed and secured or occupied, within <br />45 days from the date this order is duly served upon him; and <br />BE IT FURTHER RESOLVED, that a motion for summary enforcement <br />of this order be made to the District Court of Hennepin County, State <br />of Minnesota, unless corrective action is taken by the said Ronald L. <br />and Jane C. Carrigan or unless their answer is filed within the time <br />specified in Minnesota Statutes 463.18; and <br />BE IT FURTHER RESOLVED, THAT THE Village Administrator and <br />Village Attorney be, and hereby are directed to prepare and serve this <br />order.and take all other necessary action in accordance with this <br />resolution and in accordance with Minnesota Statutes 463.15 through <br />463.26. <br />Adopted by the Village Council of the Village of Orono, Minnesota, at a <br />regular meeting held April 24, 1972, by a vote of 3 ayes and 0 nays. <br />Louis B. 0 er auser, Mayor <br />Attest <br />Ralph H.
