The City Council finds that the conditions existing on this <br />property are peculiar to it and do not apply generally to other <br />property in this zoning district; that granting the variances would <br />not adversely affect traffic conditions, light, air nor pose a fire <br />hazard or other danger to neighboring property; wculd not merely serve <br />as a convenience to the applicant, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to preserve a <br />substantial property right of the applicant; and would be in keeping <br />with the spirit and intent of the Zoning Code and Comprehensive Plan <br />of the City. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon the above findings, the Orono City Council hereby <br />grants a variance to the Municipal Zoning Code Section 10.22, Subdivision 2 <br />to permit the construction of a detached garage and associated driveway <br />apron which in conjunction with a future proposed home addition will <br />increase hardcover in the 75-250' setback zone in excess of the 25% hard- <br />cover allowed, and grants a variance to Section 10.03, Subdivision 15 (F) <br />to allow the detached garage to be located 5' from the side lot line <br />instead of the required 10' setback, subject to the following conditions: <br />1. The garage shall be located no less than 10' from the street lot <br />line. <br />2. Maximum allowed hardcover on the property in the 75-250' lakeshore <br />setback zone is 27% or 2,424 s.f. as follows: <br />Existing House <br />Proposed Garage <br />Proposed Driveway, <br />Not to Exceed <br />933 s.f. <br />528 s.f. <br />House Addition, Side <br />963 s.f. <br />Etc., <br />3. The existing decks as of the date of this resolution are shown on <br />the survey attached (Exhibit A). Those decks are not considered as <br />hardcover, per Resolution No. 1730 of the City Council.
