Zoning File «1381 <br />Additional Cnunta and Planning CoHniasion Racn—ndation * <br />March 3, 1989 <br />The Planning Cominiasion unanimously approved Mr. Rhode's variance <br />application that would allow the total reconstruction of a residence using <br />the existing foundation. The new residence structure would be located 61* <br />(second level deck extends 2* beyond lake front of principal residence at <br />59') resulting in an improved lakeshore setback from the existing at 55'. <br />The Planning Cosimission's approval was based on the following hardships and <br />findings: <br />1. Use of existing foundation will result in less of an impact on the <br />lakeshore property. <br />2. The house was constructed prior to lakeshore setback regulations <br />and standards. <br />3. The improvement will result in reductions in hardcover in the 0-> <br />75' setback zone and improved lakeshore setbacks. <br />4. The proposed improvement of the property will not require an <br />additional variances but will result in the reductions of the <br />intensity of existing variances on the property. <br />Approval was subject to the following conditions: <br />1. All hardcover scheduled for removal must be completed prior to the <br />final inspection by the Building staff for new construction. <br />2. Applicant to provide a Highway Department permit for the relocated <br />curb cut to the site. <br />3. Applicant or applicant's architect shall provide the Building <br />staff with the engineering data or findings that confirm that the <br />existing foundation can sustain a 2-story structure. If at any time <br />it is revealed that the existing foundation cannot sustain the <br />proposed residential structurer applicant will be required to return <br />to the Planning Commission and Council for further consideration. <br />The enclosed resolution has been drafted per the Planning Commission's <br />unanimous recommendation.
