The City Council finds that the conditions existing on this <br />property are peculiar to it and do not apply generally to other <br />property In this sonlng district; that granting the variances would <br />not adversely affect traffic conditions# light# air nor pose a fire <br />hazard or other danger to neighboring property; would not merely serve <br />as a convenience to the applicant# but is necessary to alleviate a <br />demonstrable hardship or difficulty; Is necessary to preserve a <br />substantial property right of the applicant; and would be in keeping <br />with the spirit and intent of the Zoning Code and Comprehensive Plan <br />of the City. <br />COKL08IOHS, omm AID COHDlTIOra <br />Based upon the above findings, the Orono City Council hereby <br />grants a variance to Municipal Zoning Code Section 10.25# Subdivision 6 (B) <br />to permit the construction of residential additions being 9.1' from the <br />west side lot line and 9.6* from the east side lot line where 10' side <br />setbacks are normally required# and grants a variance to Section 10.22# <br />Subdivision 2 to allow hardcover of 28.1% in the 75-250' lakeshore setback <br />zone where '^ly 25% hardcover is normally allowed, subject to the following <br />conditions: <br />1. Applicant shall retain the existing detached garage and may <br />rebuild or upgrade that 1-story garage at It? present location 9.6' <br />from the side lot line. <br />2. The west side lot line setback variance to allow a 9.1* side <br />setback specifically allows a 2-story addition to be constructed at <br />that location. <br />3. The existing 85 s.f. storage shed shall be moved within the <br />property boundaries to be located outside the 75-250' lakeshore <br />setback zone. <br />4.
