Minnesota SS 'l4•Municipal (Hficer <br />On the North .Shore of Lake Minnetonka <br />July 30, 1987 <br />The following is a schedule of events which occurred on <br />January 2, 1987 in regard to a watermain break near your <br />residence at 1940 Concordia. <br />At approximately 3:30 P.M. on the above date Jerry Smith, <br />utility Mechanic, noticed the main break, it is his recollection <br />that he contacted his Supervisor, contacted some of the <br />neighboring residents and then started to close valves in the <br />system. After closing two valves on Concordia and Webb Streets <br />it was determined that the valve for all of Fagerness Point would <br />have to be closed. That valve is at the intersection of <br />Fagerness Point Road and Shadywood Road (County Road 19). <br />The repair to th,• main was completed at 9:30 P.M. that same <br />evening. <br />During the time that the water was running on top of the <br />ground mud washed onto your driveway and lawn. We did clean off <br />as much of the mod as possible and placed crushed limestone on <br />your driveway. It was also agreed that we would drop off 34 <br />yards of sod which you were going to place yourself. Apparently <br />between January 2 and May of 1987 you felt that the City should <br />expand what was formerly a -reed upon and you were requested to <br />submit on estimate which we received on May 25, 1987. <br />Because of the amount of the repair estimate it was my <br />decision to submit your claim to our insurance company. <br />At thiE. date it is still my opinion that there was no <br />negligence on the part of the City and t:iat City personnel <br />responded to the: situation in a manner that is expected of them. <br />The reason that we restored your property as we did was a <br />courtesy and not accepting any liability. <br />The Adjuster for the insurance company has deemed liability <br />in the case as noted in the attached correspondence.
