RESOLUTION #409 <br />A RESOLUTION AUTHORLZING PAYMENT OF A SUM OF <br />MONEY FOR ADDITIONAL SERVICES RENDERED <br />LAYNE MINNESOTA <br />WHEREAS, Layne Minnesota was required to expend extra labor and <br />materials above the contract specifications for Deep Well No. 1 due <br />to unusual geological problems; and <br />WHEREAS, the unusual geological problems caused Layne Minnesota to <br />take a greater length of time to complete the wzl.l than indicated in <br />the terms of the contract; and <br />WHEREAS, the Village of Orono and Layne Minnesota entered into a <br />change -order agreement on April 22, 1971, for said additional work <br />while leaving the question of cost to the Village open for subsequent <br />negotiation; and <br />WHEREAS, the Village -of Orono and -Layne Minnesota have agreed that the <br />fair and reasonable value of said work to the Village of Orono if <br />$15,600.00; and <br />WHEREAS, Layne Minnesota has agr.e:e.d to accept the sum-, of $15,600.00 <br />from the Village of Orono in full and complete sett.jpment•,for the cost <br />of said work; <br />NOW, THEREFORE, IT IS HEREBY RESOLVED that: <br />1. The Treasurer for the Village of Orono shall direct'a check to <br />} Layne Minnesota Company in the amount of $15,600.00 in full and complete <br />settlement, accord and satisfaction for invoices numbered N-1, N-2 and <br />N-.3 and dated July 14, 1971. <br />2. No penalty'is to be imposed for the failure of Layne Minnesota to <br />complete the well within the period specified in -the contract except <br />any work still remaining to be done shall be completed within a <br />reasonable period of time. <br />Adopted by the Village Council of the Village of Orono, Minnesota at a <br />regular meeting held September 27, 1971. <br />outs B.
