I <br />RESOLUTION #402 <br />A RESOLUTION MODIFYING EXISTIN,, ONTRACT WITH <br />HOFFMAN BROS. CONSTRUCTION COMP�N AND ADDING <br />THERETO ON A UNIT PRICE BASIS THE W R IMPROVEMENTS IN A <br />PORTION OF CASCO POINT INCLUDING CASCO CIRCLE, IVY <br />PLACE AND AN AREA CONSISTING OF FIVE HOMES ON COUNTY <br />ROAD 51 -TO THE HENDRICKSEN BRIDGE AREA OF ORONO FOR* <br />1970LW-1B <br />WHEREAS, the Village of Orono has'an existing contract with <br />Hoffman Bros. Construction Company, dated November 23, 1970, said <br />contract being let pursuant to statute and after advertising for bids, and <br />WHEREAS, said contract was awarded on a unit price basis and <br />it is now the desire of the Council to include additional units at the <br />same unit price to complete the.water improvements in the following area: <br />A portion of Casco Point including Casco Circle, Ivy <br />Place and an area consisting of five homes on County <br />Road 51 to the Hendricksen Bridge area of Orono - <br />WHEREAS, the additional units do not exceed 25% of the original <br />contract, price , and..,. <br />WHEREAS, the contractor, Hoffman Bros. Construction Company, <br />has agreed to add such additional units at the same unit price and all <br />in accordance with Chapter 429.041;.Subd....7y of Minnesota Laws. <br />NOW, THEREFORE, BE IT RESOLVED by�the Village Council of the <br />Village of Orono as follows: <br />1. The Mayor and Clerk are hereby authorized and directed <br />to enter into p'contract with Hoffman Bros. ;Construction Company for <br />additional un,i�-s of work, at• a-, co•st-• of•. .$.7.7,000, in the name of the <br />Village of Orono,for, the.aforps.aid improvements, according to the plans <br />and specific,ation�sr. ola;-fide•, in. t1h-e, office of the Clerk. <br />2. The contractor shall file an increased bond to cover the <br />full contractual amount and the contractor's written agreement to add <br />to the existing contract, at the same -unit price as the original contract, <br />shall be placed on file with the Clerk and made a part of the original <br />contract, all in accordance with Chapter 429.041, Subd. 7., of Minnesota <br />Laws. <br />Adopted by the Village Council•of the Village of Orono, Minnesota, at <br />a regular meeting held July 26, 1971. j <br />i• <br />Louis B.
