CITYof ORONO <br />Pom Office Flux 66•('ryaW flay, Minnpno a 5.UZJ*Munieipal Offwaa <br />On the North Shore of Lake Minnetonka <br />June 19, 1987 <br />Nancy Dussol <br />Merrill Lynch Realty <br />19400 Highway 7 <br />Excelsior, MN 55331 <br />Dear Ms. Dussol: <br />I have discussed the matter of your request as set forth in your <br />letter of May 19, 1987 with the City Attorney. <br />In order to confirm the validity of the exclusive easement for <br />dockage and non-exclusive access easement over Lot 31, Coffee's <br />Addition to Shadywood in favor of your client's property, we would <br />recommend that ycu obtain current title information on Lot 31 to <br />insure that the easements were not extinguished at the time of the <br />1982 sale by the Eberhardt Realty Company to James and Helen Kramer of <br />1937 Fagerness Point Road. <br />If the easements are proven valid, the City of Orono would ask <br />that the following be completed and/or submitted to the City before a <br />permit can be issued for a new dock: <br />1. Approval of a joint use dock license by Orono and the Lake <br />Minnetonka Conservation District. The license application with <br />the City of Orono must include the following information: <br />a) List of a 1 1 other property owners with valid riparian <br />easement rights over Lot 31. <br />b) Survey locating each riparian land area and the <br />pedestrian access. <br />c) Dock plan for each riparian tract. <br />2. Approval by the LMCD of al l setback variances for the <br />proposed dock (10 feet side setback required from all side <br />property lines). <br />3. Approval by the City of a variance to permit an accessory <br />structure on a lot that does not contain a principal structure. <br />4.
