32 <br />14.9.2 The Additional Real Estate is described in Exhibit C attached hereto. The <br />Additional Real Estate may be added to the Property in parcels consisting of one or <br />platted or un-platted parcels, or portions thereof, and in any sequence. <br /> <br />14.9.3 Declarant has no obligation to add the Additional Real Estate to the Property. If <br />Declarant decides to add the Additional Real Estate to the Property, there are no <br />assurances as to the times at which any part of the Additional Real Estate will be <br />added, the order in which it will be added, the number of Units per phase nor the <br />size of the Units. The Additional Real Estate may be developed by Declarant or its <br />successors in interest for any purpose, subject only to approval by the appropriate <br />governmental authorities. The maximum number of Units that may be created <br />within the Additional Real Estate described as such on the date of this Declaration <br />is approximately 9 Units. All Units created on the Additional Real Estate shall be <br />restricted exclusively to non-residential use. <br /> <br />14.9.4 The Units, Buildings and any other improvement created upon the Additional Real <br />Estate will be compatible with the Units, Buildings and any other improvement <br />which is initially a part of the Property, in terms of general architectural style, <br />quality of construction, principal materials employed in construction, subject to <br />market conditions and governmental and lender requirements. <br /> <br />14.9.5 All covenants and restrictions contained in this Declaration affecting the use, <br />occupancy and alienation of Units shall apply to all Units created on the Additional <br />Real Estate. <br /> <br />The statements made in this Section 14.9 shall not apply to any Additional Real Estate which is <br />not added to the Property. <br /> <br />14.10. Other Rights. To have and exercise such other rights as are afforded Declarant <br />under the terms of this Declaration or identified, now or in the future, as special declarant rights <br />in Section 515B.1-103 of the Act. <br /> <br />SECTION 15 <br />AMENDMENTS <br />15.1. Approval Requirements. Except as otherwise provided herein, this Declaration <br />may be amended only by the approval of: <br /> <br />15.1.1. The Board. <br /> <br />15.1.2. Owners of Units to which are allocated at least sixty-seven percent of the <br />total votes in the Association. <br /> <br />15.1.3. Declarant pursuant to Section 14.7. <br /> <br />15.2. Procedures. Approval of the Owners may be obtained in writing or at a meeting of <br />the Association duly held in accordance with the Bylaws. Consent of the Declarant shall be in <br />145
