Date: March 17, 2025 Item: 5.1 <br />Presenter: Melanie Curtis, Planner <br />Section: Public Hearings <br /> <br />Title: LA25-000007, Matt Jasper, 4745 North Shore Drive, After-the-Fact <br />Conditional Use Permit Amendment (Staff: Melanie Curtis) <br /> <br /> <br />1.Purpose: <br />The purpose of this application is to consider new retaining walls within the bluff and lake setback <br />installed without City approval. An after-the-fact amendment to the CUP is required. <br />2.MN§15.99 Application Deadline: <br />The application was received on January 30 and considered to be complete on February 14; <br />therefore the 60-day review timeline will expire on April 15, 2025. <br />3.Background: <br />The applicant received approvals in 2024 to improve the long-neglected bluff and shoreline with a <br />new, set-in-grade stone stair with two retaining wall-supported landings and a single retaining wall <br />located immediately upslope from the new rip-rap (and rip-rap permitted by the MCWD). Upon <br />completion, the City’s inspector visited the site and observed additional walls which were not <br />included in the scope of the approved plan, walls within bluffs and lake setback area can only be <br />authorized by the City Council through a conditional use permit process. <br /> <br />Planning Commission June 2024: PACKET / VIDEO <br />City Council July 2024: PACKET <br /> <br />When notified by the City, the applicant applied for consideration of an after-the-fact amendment <br />to the CUP issued under Resolution No. 7486 (Exhibit B).
