All existing unnecessary walls within 75' of the lake are being <br /> elimiiiated as part of this replacement plan. <br /> d. The existing deck, associated staircase, and fire-pit partly within the 0- <br /> 75' zone a.nd 75'-250' zone are being removed. <br /> • 4. The City Council has considereci this application including the findings <br /> and recommendation of the Plannin� Commission, reports by City staff, <br /> comments by the applicants and the public, and the effect of the proposed <br /> conditional use permit and variance on the health, safety and welfare of <br /> the community. <br /> 5. The City Council finds that the conditions existing on this property are <br /> peculiar to it and do not apply generally to other property in this zoning <br /> district; that granting the conditional use pei7nit and variance would not <br /> adversely affect traffic conditions, light, air nor pose a fire hazard or other <br /> danger to neighboring property; would not merely serve as a convenience <br /> to the applicants, but is necessary to alleviate a denlonstrable hardship or <br /> difficulty; is necessary to preserve a substantial property right of the <br /> applicants; and would be in keeping with the spirit and intent of the <br /> Zoning Code and Comprehensive Plan of the City. <br /> � CONCLTJSIOI�S, ORDER ANI) CONDI'�"IONS <br /> Based upon one or more of tlie above findings, the Orono City Council hereby <br /> grants a conditional use permit including a 0-75' hardcover variance per Orono <br /> Municipal Zoning Code Sections 78-966 (A) and 78-1288 (A) to allow replacement of <br /> existing timber retaining walls with keystone walls; all within 75' of the OHWL of Lake <br /> • Minnetonka, constituting 7.7% hardcover where 0% is normally allowed and 14.5% <br /> cunently exists, subject to the following conditions: <br /> � Page 2 of 5 <br />
