Y <br /> 1 <br /> � O� <br /> � O �, O <br /> - C ITY of ORONO <br /> � - - . � <br /> , ti <br /> �'�� �G'�' � RESOLUTION OF T SE�CI�TY� COUNCI L <br /> `�kESI;�4� NO. <br /> a) Permaneilt docks are allowed by Conditional Use Permit in the floodway and <br /> flood fringe of Lake Minnetonka per the provisioiis of Orono Mtuucipal Code <br /> Section 78-1116(a)(S). <br /> b) Docks which provide reasonable access to the lakesliore and do not exceed 8' <br /> in width are a pennitted use within wetlands per the provisions of Municipal <br /> Code Section 78-1606(a)(4). <br /> c} The properly abuts the shore of Lake Minnetonka,and the proposed dock will <br /> be constructed within a lake perimeter wetland and will provide reasonable <br /> access to the lake for the applicants' stated intent of nature enj oyment, <br /> . fishing, etc. The docic is not specifically intended for boat storage. The <br /> proposed permanent dock will be 100' in length extending lakeward from the <br /> shoreline,being 8' in width and having a"T" section at the lakeward end of <br /> • dimension 8' x 24'. � <br /> d) The proposed dock location is within a small inlet connecting to Crystal Bay <br /> of Lake Minnetonka where wave and ice action will be minimal, hence the <br /> stability of the dock will be at minimal risk, and will not require winter de- <br /> icing to maintain its integrity. <br /> e) The proposed permanent dock by virtue of its location in Lake Minnetonka <br /> is under the jurisdiction of the Lake Minnetonka Conservation District <br /> (LMCD) and is subject to the LMCD permitting process. <br /> � The proposed permanent dock will be located to meet LMCD setback, <br /> location and len;th standards and is not anticipated to result in conflicts with <br /> adjoiniilg docks nor pose any navigation hazards. <br /> 4. The City Council finds that the conditions existing on this property are peculiar to it <br /> and do not apply generally to other properiy in this zoning district, and that granting <br /> of the conditional use permit would be in keeping with the spirit and intent of the <br /> Zoning Code and Comprehensive Plan of the City. <br /> � . <br /> Pa�e 2 of 5 <br />
