Gustafson and Ethel M. Gustafson, husband and wife (hereinafter "the applicants") are the owners of the property located at 4203 North Shore Drive within the City of Orono (hereinafter the "Cit}�') and legally described as • follows: That.part of Lot 3, ORCHARD BEACH, lying westerly of the following described line: Commencing at the Northeast corner of said Lot 3; thence South along the East line thereof 190.2 feet; thence at an aiigle to the right of 48 degrees 28 minutes to the shore of Lake Minnetonka, and there terminating, Hennepin County, Minnesota (hereinafter the "property"); and WgIEREAS, the applica.nts have made application to the City of Orono for a lot width variance and a conditional use permit for fill in excess of 500 cubic yards per Orono Municipal Zoning Code Sections 78-330 (B), 78-967 (B) (2), and 78-1286 (D) (2) to allow construction of a new residence on an existing lot which has 90' in width at the shoreline and 117' in width at the 75' setback where 140' in width at both the shoreline and at the 75' setback is normally required, and to incorporate approximately 770 cubic yards of fill into the street side of the property.
