NO. 7568 <br /> I"kESHO��C <br /> A RESOLUTION <br /> DENYING A VARIANCE FROM <br /> MUNICIPAL ZONING CODE <br /> SECTION 78-1279 <br /> FILE NO. LA25-000005 <br /> WHEREAS, on January 21, 2025, Schwarz Builders Inc. ("Applicant"), applied for a <br /> variance from the City Code for the property addressed 1480 Bohns Point Road and legally <br /> described as: <br /> That part of the South 800.00 feet of Government Lot 1, Section 9, Township 117 <br /> North, Range 23, West of the 5th Principal Meridian, described as follows: Beginning at <br /> the Northwest corner of said South 800.00 feet; thence East along said North line of said <br /> South 800.00 feet, 430,26 feet; thence deflecting right 12 degrees 06 minutes, 70 feet, <br /> more or less, to the shore of Lake Minnetonka; thence southwesterly along said shore line <br /> 140 feet, more or less, to the North line of the South 650.00 feet of said Government Lot <br /> 1; thence West along said North line to the West line thereof; thence North along said <br /> West line to the point of beginning, Hennepin County, Minnesota (hereinafter the <br /> "Property"); <br /> WHEREAS,the Applicant has made application to the City of Orono for a variance <br /> from Orono Municipal Zoning Code Section 78-1279 to rebuild an existing accessory shed within <br /> the average lakeshore setback; and <br /> WHEREAS, on February 18, 2025, after published and mailed notice in accordance <br /> with Minnesota Statutes and the City Code, the Planning Commission held a public hearing, at <br /> which time all persons desiring to be heard concerning this application were given the opportunity <br /> to speak thereon; and <br /> WHEREAS, on February 18, 2025, the Planning Commission voted 6 to 1 in favor <br /> of a motion to recommend denial of the variance as recommended by staff; and <br /> WHEREAS, on March 10, 2025, the City Council reviewed the application and the <br /> recommendations of the Planning Commission and City staff; and <br /> NOW,THEREFORE, BE IT RESOLVED that the City Council of Orono, Minnesota <br /> hereby denies the requested variance as described above based on one or more of the following <br /> findings of fact concerning the Property: <br /> 1 <br />
