Attorney's Opinion Dated 3/iyS7 <br />ISSUE - Transmission of information to Council regarding its <br />rights vis-a-vis the County relating to jurisdiction over a <br />current M.S.A. street. <br />INTRODUCTION - At Council's -last meeting the issue of 116 being <br />extended from Highway 55 down to Highway 12 along Willow was <br />discussed. At that meeting the issue regarding the City's <br />ability to prevent Hennepin County from taking over the Orono <br />section of Willow, should they desire to build it, was discussed. <br />It was requested that the City Attorney research the issue. <br />DISCUSSION - Based on a review by the Attorney it is our present <br />understanding that while the County may have some authority in <br />taking ovtr the road from the City as it currently exists, a <br />M.S.A. street, the legalitv of the situation would require a <br />court hearing on the matter. Additionally since the road request <br />is one initiated by the City of Medina and not Hennepin County it <br />is not anticipated that the County would not force the issue and <br />may drop the entire project if Orono is in opposition. <br />RECOMMENDATION - That the Council accept the information from the <br />City Attorney and that upon Medina taking formal action on the <br />matter a public hearing be scheduled for the City of Orono. <br />PROPOSED MOTION - Moved by,seconded by <br />Attorney's information on the^^tter anp ^abl^ <br />future public hearing.
