Procedures for Marina License Review <br />January 17, 1989 <br />Page 6 of 6 <br />Regarding the existence of a marina committee, staff feels that in the <br />past the marina committee has been ineffective because it has no authority <br />to negotiate or approve licenses. The marina committee has no mandate for <br />its existence in the municipal code. <br />Regarding making marinas a conditional use within the B-2 zoning <br />district, staff feels that a zoning code change of that magnitude would <br />result in a long and expensive lawsuit with questionable result. <br />Finally, staff recommends that if marina licensing is continued, it <br />should be merely an automatic, administrative procedure similar to our <br />licensing of other businesses such as garbage haulers and septic <br />contractors. Until such time that the Council decides to take a strict <br />enforcement attitude towards making existing "grandfathered" marinas up­ <br />grade to meet current zoning standards, the licensing process is nothing <br />but a fund-raising tactic.
