Gaffron, Asst Planning 6 Zoning Administrator <br />Date:January 17, 1989 <br />Subject: Procedures for Marina License Review <br />The City of Orono has licensed marinas since the early 1960s. In the <br />1970s and through 1985, a "marina committee" in conjunction with staff, <br />reviewed marina license applications on an annual basis and recommended <br />approval or disapproval to the City Council. The marina committee <br />typically consisted of three members, one from Council and two from the <br />Planning Commission. <br />City codes do not specifically recognize, authorize or specify duties <br />of a Marina Committee, although formation of such a committee is probably <br />not strictly prohibited. Note that the creation of boards and commissions <br />is regulated under Section 2.50 which suggests that such boards or <br />commissions should be more of a formal nature (copy attached). The Marina <br />Committee in the past has functioned strictly as a recommending body <br />regarding licensing of marinas, but has had no definite authority to make <br />land use or license approval decisions. <br />Marina licensing historically has been approved or disapproved by the <br />City Council based on issues which may or may not be strictly under City <br />jurisdiction. Often, in an attempt to show a united front with the LMCD, <br />the City has withheld licenses based on dock use issues which are not <br />specifically regulated in Orono codes. On other occasions, the City has <br />been in opposition to LMCD interpretations and has issued licenses without <br />consulting the LMCD (case in point is the Chaska Marina dock layout in <br />relation to neighboring properties, in which the LMCD was pushing for a <br />dock layout that in the opinion of the affected neighbor and City staff was <br />more of a problem to the neighbor than what the marina had in place).
