A RESOLUTION VACATING PORTION’S OP <br />A DRAINAGE ft UTILITY EASE^.^:NT <br />ffITHIN LOT 2, BLOCK 2, ORONO SCHOOL EXPANSION <br />SECTION 28, TOWNSHIP 118, RANGE 23 <br />IN THE CITY OF ORONO, HENNEPIN COUNTY, MINNESOTA <br />FILE NO. 1361 <br />WHEREAS, the Cit^ of Orono is a municipal corporation organized <br />and existing under the laws of the State of Minnesota; and <br />WHEREAS, on December 12, 1988, Orono Schc^l District #278 filed a <br />petition with the City of Orono requesting the vacation of a portion of <br />drainage and utility easement originally dedicated within the plat of <br />Crystal Crest, legally described as follows: <br />That part of the South 5 feet of Lot 1, Block 1, Crystal Crest <br />according to the recorded plat thereof, Hennepin County, Minnesota, <br />lying East of the West 652 feet of said Lot 1, and West of the East <br />25' of said Lot 1; <br />That part of the North 5 feet of Lot 2, Block 1, Crystal Crest <br />according to the recorded plat thereof, Hennepin County, Minnesota, <br />lying East of the West 652 feet of said Lot 2, and West of the East 25 <br />feet of said Lot 2. <br />WHEREAS, after due published and posted notice a public hearing <br />was held before the Planning Commission on January 17, 1989 regarding said <br />vacation and all persons interested were given an opportunity to be heard; <br />and <br />WHEREAS, after due standing and consideration, the Planning <br />Commission recommended approval of the requested vacation and the Council <br />of the City of Orono finds that said vacation, as proposed, is in keeping <br />with the public interest in consideration of the following findings: <br />1. That portion of the Jrainage and utility easements serve no <br />public purpose. <br />2. The location of the drainage and utility easement within Lot 2, <br />Block 2, Orono School Expansion places severe restrictions on the <br />building envelope. <br />NOW, THEREFORE, BE IT RESOLVED that the petition of Orono School <br />District #278 is hereby granted and that the portion of the dedicated <br />drainage and utility easement legally described above is hereby vacated. <br />Page 1 of 2
