Zoning File #1296 <br />January 4, 1989 <br />Page 3 of 4 <br />B) The credit of the principal residence for an accessory <br />use/structure serving an adjacent property will establish a <br />negativ*^ precedent for the City when dealing with similar <br />requests /or accessory uses and structures on unbulldabler <br />substandard lots. <br />And to direct staff to amend the original denial resolution of <br />Application #1296 to address the current proposal of the applicants <br />and to present the amended resolution for Council action at their <br />January 23, 1989 meeting. <br />And to further direct staff to advise Mr. Tillotson in writing that <br />his present dock is in violation of the LMCD and municipal codes and <br />that the dock must be brought into conformance by opening of boat <br />season of 1989. This can be accomplished by relocating dock or by a <br />lot line rearrangement with the property owner of Tract P. <br />To further direct staff to prepare an ordinance amendment of Section <br />5.42, Subdivision 1 (F) (Joint Use Definition), that would allow 2 or <br />more property owners to join in the sharing of combined shorelines for <br />dock use purposes only if there is a principal structure on each of <br />the individual properties. The definition will continue to allow the <br />sharing of a riparian outlot/tract owned by a homeowners* <br />association/multiplfi property owners for shared dock use purposes to <br />be consistant with current land use practices within City. As this is <br />not a zoning ordinance, this can be done by action of the Council <br />without a public hearing. <br />2. To concur with the interpretation of the code as presented by <br />applicants and to adopt resolution that would deny Tracts F & G as a <br />buildable lot. <br />Applicants are to proceed with the appropriate lot line rearrangement <br />subdivision application with the Tillotson property. Conditions of <br />approval of that subdivision will require: <br />a) The residentia** dock be totally located on the newly re­ <br />aligned Tillotson property and contain only 4 slips (2 credited <br />to the Peterson/Stodola property; 2 to the Tillotson property). <br />b) All boats must be licensed to Tillotson/Peterson/Stodola and <br />copies of the registration must be on file with the City with <br />appropriate notification to the LMCD. <br />c) Tracts B, C, D, F & G of RLS #1216 and Parcel 0003 to be <br />legally combined. <br />d) All future use of the undeveloped Peterson/Stodola property <br />is subject to the review and approval of the City of Orono.
