AGENDA ITEM Date: March 10, 2025 Item: 16 Title: LA25-000008, 2475 Kelley Parkway, Final Master Development Plan - 5th Extension - Resolution 7569 Presenter: Laura Oakden, Community Development Director Section: Consent Agenda Purpose: To grant an extension to the final Master Development Plan approval for the 56 unit apartment building at 2475 Kelley Parkway. 2. Background: In April, 2020, the City Council approved the final Master Development Plan which was the final step in the approval necessary to facilitate construction of the 56 unit 2 1/2 story apartment building on a vacant lot at 2475 Kelley Parkway immediately east of the Orono Dentist office. The Resolution of approval included the statement: The approvals granted by this resolution nun with the Property not with the Applicants, but are permissive only and must be exercised by obtaining a building permit for the new construction and commencing construction of said project. A building permit for the principal building shall be obtained within one year of the date of Council approval, if no permit is issued or extension granted by the City Council, the City Council may declare the approvals granted within this resolution as null and void on that date (April 13, 2021). Staff granted a 1-year administrative extension until April 13, 2022. On January 24, 2022 the City Council granted an extension (Resolution 7248) until April 13, 2023. On March 21, 2023 a third extension was granted until April 13, 2024. On March 11, 2024 a forth extension was granted until April 13, 2025 The applicant has requested an additional 1-year extension which would end April 13, 2026 if approved. The City Code does not limit the number of extensions allowed. The applicant has submitted a letter included as Exhibit B. Previously, in previous extension requests the applicant stated that the covid pandemic was a large cause of the delay over the past few years. The applicant is stating they intent to pull a building permit this spring (2025) as they are actively working to secure financing for the project. 3. Staff Recommendation: Staff recommends the Council approve a 12-month extension to April 13, 2026.
