AGENDA ITEM <br />Date: March 10, 2025 <br />Item: 15 <br />Title: LA24-000065, 980 Heritage Lane, Conditional Use Permit - Resolution <br />7561 <br />Presenter: Matt Karney, Planner <br />Section: Consent Agenda <br />Purpose: <br />The applicant requests a conditional use permit for new retaining walls within the lakeshore <br />setback. <br />2. MN§15.99 Application Deadline: <br />The application was made on December 3, 2024 and deemed complete on February 4, 2025. <br />Following the 60-day review period this application expires on April 5, 2025. <br />3. Background: <br />The applicant proposes a new retaining wall to allow for a level access point to an existing lake <br />stair with railings, within 75 feet of the Ordinary High Water Level of Tanager Lake. Currently, <br />the land near the stair access is sloped and not level with the wooden landing of the stairs making it <br />challenging to access the stairs. The new retaining wall is minimal is size and will allow the area to <br />align with the lake stairs. <br />Link to Planning Commission Packet. <br />4. Planning Commission Vote and Comment: <br />On February 18, 2025, the Planning Commission held a public hearing and discussed the requested <br />conditional use permit. Following the public hearing, the Commission voted 7-0 to recommend <br />approval of the conditional use permit as recommended by staff. <br />Link to Planning Commission Video. <br />Public Comment: <br />No public comments have been received. <br />6.
