AGENDA ITEM <br />Date: March 10, 2025 <br />Item: 19 <br />Title: LA25-000004, 3545 Ivy Place, Average Lakeshore Setback Variance - <br />Resolution 7567 <br />Presenter: Melanie Curtis, Planner <br />Section: Consent Agenda <br />Purpose: <br />This item contemplates an average lakeshore setback variance for a new home. <br />2. MN§15.99 Application Deadline: <br />This application was received on January 20, and considered to be complete on January 27. <br />Therefore the 60-day review period will end on March 28, 2025. <br />3. Background: <br />The new owners of the property were granted an average lakeshore setback variance for a new <br />home in August of 2024 (file LA24-000037; Resol. 7500). Since that time, they made minor <br />adjustments to the house plans resulting in small footprint changes and, because the average <br />lakeshore setback greatly impacts the property, new variances are required. <br />The previous variance application did not identify an abutting neighbor on the north/east side, so <br />the measured distance between the lake and the western neighbor, at 3535 Ivy Place, was applied <br />to the subject property as the average lakeshore setback (Section 78-1279). However, the updated <br />survey submitted for the current application shows an approximate 18-foot-wide connection <br />between the subject property, and 3570 Ivy Place across Ivy Place making it the second adjacent <br />lakeshore neighbor. <br />The updated survey (Exhibit B), shows the revised average lakeshore setback line bisecting the <br />proposed home. The subject property and 3535 Ivy Place each face the cove; 3570 Ivy Place fronts <br />the Lake; the rear of the home faces the cove. Please refer to the Planning Report for a full <br />analysis. <br />4. Planning Commission Vote and Comment: <br />At their meeting on February 18th, after the public hearing the Planning Commission voted 7 to 0 <br />in favor of recommending approval. <br />Public Comment: <br />We received comments from one neighbor with the primary concerns having to do with <br />construction and safety on the Ivy Place roadway <br />6. Staff Recommendation: <br />Staff recommends approval. <br />COUNCIL ACTION REQUESTED <br />Council should move to adopt Resolution 7567 approving the average lakeshore setback variance. <br />172 <br />
