Further, hardcover in the <br />250-500' zone will increase from the existing 22.8% to 60`I proposed <br />by the applicant where only 30% is normally allowed, however, a <br />hardship is the small size of the 250-500' zone and the variance is <br />justified by the concur-ent removal of hardcover in the 0-75' zone and <br />general reconstruction of hardcover at locations further from the lake <br />than currently exists. Overall hardcover on the property is proposed <br />to decrease from 5,715 s.f. (28.51/'c) to approximately 5,350 s.f. <br />(26.7%), where the entire lot would normally be allowed 18.3 <br />hardcover under normal hardcover limitations. <br />4. The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City staff, comments <br />by the applicants and the effect of the proposed variance on the health, safety <br />and welfare of the community. <br />5. The City Council finds that the conditions existing on this property are <br />peculiar to it and do not apply generally to other property in this zoning <br />district; that granting the variance would not adversely affect traffic <br />conditions, light, air nor pose a fire hazard or other danger to neighboring <br />property, would not merely serve as a convenience to the applicants, but is <br />necessary to alleviate a demonstrable hardship or difficulty; is necessary to <br />preserve a substantial property right of the applicant; and would be in keeping <br />with the spirit and intent of the Zoning Code and Comprehensive Plan of the <br />City. <br />CONCLUSIO`S, ORDER AND CONDITIONS <br />Based upon the above findings, the Orono City Council hereby grants <br />variances to Municipal Zoning Code Section 10.25, Subdivision 6 (B) to permit the removal <br />of the existing residence, deck and detached garage and construction of a new residence, <br />deck and detached garage on a lot of area 0.46 acre where a 0.50 lot area is normally <br />required, and on a lot of width 75' where a 100' lot width is normally required; and grants <br />a variance to Section 10.22, Subdivision 1 to allow the new residence and deck to be <br />constructed lakeward of the defined average setback line, and grants a variance to Sections <br />Page 3 of 7 <br />
