The property is located on a busy street where a sign 12 s.f. in size per <br /> � � Zoning Ordinance Section 78-1467 would not be visible due to the <br /> high levels of traffic and speed. <br /> d. The applicant has proposed to reniove ap�roaimately 32 s.f. of <br /> hardcover within the 250'-500' zone. <br /> • � <br /> 4. The City Council has considered this application including the findings � <br /> and recommendation of the Planning Commission, reports by City staff, <br /> comments by the applicant and the public, and the effect of the proposed <br /> variances on the health, safety and welfare of the community: <br /> 5. The City Council finds that the conditions existing on.this property are <br /> peculiar to it and do not apply generally to other property in this zoning � <br /> district; that granting the variances would not adversely affect traffic <br /> conditions, light, air nor pose a fire hazard or other danger to neighboring <br /> property; would not merely serve as a convenience to the applicant, but is <br /> necessary to alleviate a demonstrable hardship or diff'iculty; is necessary to � <br /> preserve a substantial property right of the applicant; and would be in <br /> keeping with the spirit and intent of the Zoning Code and Comprehensive <br /> Plan of the City. <br /> CONCLUSIOI�S, ORDER ANI) CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereby <br /> grants a sign and hardcover variance to Orono Municipal Zoning Code Sections 78-1288 <br /> (b) and 78-1467 (1) (c) to permit replacement of the existing pylon sign approximately 60 <br /> • s.f. with a monument style sign approximately 61 s.f. where hardcover within the 250'- <br /> 500' zone is 53.9% eaisting where only 30% is nonnally allowed and 53.8% is proposed, <br /> subject to the following conditions: <br /> Page 2 of 5 <br />
