ISSUE A JOINT USE DOCK LICENSE TO KELLY COVE HOMEOWNERS ASSOCIATION SUBJECT TO CONDITIONS NOTED HERETN FOR THE PERIOD OF JANUARY 1, 2005 TO DECEMBER 31, 2005 WHEREAS,the City of Orono,hereinafter"City"is a nluiuci�al corpor�tioil orgaiuzed aiid existiiig under the laws of tlie State of Mimiesota aud has the authority and respousiUility under Miiuiesota Statutes, State Stahlte 412,et,seq. and State Stahtte 462,et.seq.,to protect ihe health,safety,and general welfare of the citizeiis of tlie City aild otl�er memUers of tlle public witlun the City; and WFIEREAS, the City shares concunent jurisdiction over the primaiy harbor limit of the City of Orono with the Lake Mimietonlca Coiiseivatioii District and the Departiiient of Nahiral Resources of the State of Minnesota; and • WHEREAS,the regt.ilation of the iiavigable waters ulvolves an exercise ofpolice power of the State, LMCD, and the City of Orono, all of wllich have adopted rules to eiisure to all equal eilj oyinent of the puUlic rights and equal protectioii from activity on or near the�ublic waters aild on the land witluu the City wluch,if tuuegulated, may be detrinlental to tlie puUlic l�ealth, safety a�id general welfare; and WHEREAS,tlie regulations of the DNR,LMCD,and tlze City of Orouo regulate tl�e property rights of the riparian owners both as to resideiitial owiiers aild tlle coirunercial inarina ov,niers i:o the exteiit proluUituig any � iiiterference with the puUlic waters adjoiiiuig their properly. The LMCD,DNR aud City of Oroiio iizust fii1fi11 their trusteeship over the public w�.ters by protecting agauist interference by auyone, iilcluding those who assert the conuiZOn law rights of ripariaii owners, whether or iiot they Ue coiiunercial iila�iiias or residential owners; WHEREAS, as to Lalce Muuletoi�lca, a iinittial right of enjoynieni exisis Uetweeii and is shared by ripa.riau owiiers and the public generally,no one riparian owner lias exclusive privileges over Lake Miruletoiika. The oiily additioiial private right that any riparian owner nlay have over the puUlic generally is to coiistruct one dock to the navigable depth of the�ublic waters. There can be no dispute but that the public geilerally and eacl�riparia�i owzler to Lake Mimzetonlca has ihe righi to use the eiitire sur�'ace area of Lake Miiuietoiilca for�11 suitable pui��oses in coiiimon with all other riparian owners.
