CITY OF ORONO RESOLUTION OF THE CITY COUNCIL G NO. 7496 1ICESHO WHEREAS, on August 12, 2024, the City Council considered the request for an interim use permit and to vacate the Easement; and WHEREAS, the City Council has reviewed the application, the public input, the recommendations of the Planning Commission, and City staff; and WHEREAS, following the hearing and consideration of the proposed vacation, the Council has determined that it is in the public interest to vacate the Easement as it affects the Subject Property and grant the interim use permit. WHEREAS, the City Council finds that vacation of the Easement is in the interest of the public. The new dedication of a drainage easement over the new stormwater pond will meet the stormwater standards for the affected area; and NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Orono, Minnesota that the Easement as it affects the Subject Property is hereby vacated and approves the requested IUP as described above based on one or more of the following findings of fact concerning the Property: FINDINGS OF FACT: 1. The analysis contained within staff memos and the exhibits attached to the aforesaid memos, all minutes from the above-mentioned meetings, and all other materials distributed at these meetings are hereby incorporated by reference. 2. The Property is located in the LR-1A, One Family Lakeshore Residential Zoning District. 3. The Applicants have applied for an IUP for grading and to vacate an existing drainage easement. 4. In considering this application for an IUP, the Council has considered the advice and recommendation of the Planning Commission and the effect of the proposed IUP upon the health, safety and welfare of the community, existing and anticipated traffic conditions, light and air, danger of fire, risk to the public safety, and the effect on values of property in the surrounding area.
