A RESOLOTION DENYING <br />AFTER-THE-PACT VARIANCES TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.22, SUBDIVISIONS 1 (B) fc 2 <br />PILE #1473 <br />ffHEREAS, the City of Orono is a municipal corporation <br />organized and existing under the laws of the State of Minnesota? <br />and <br />WHEREAS, pursuant to State Statute 412 et. seq. and 462 <br />et. seq., the City Council of the City of Orono has adopted <br />zoning regulations for the protection of the health, safety and <br />general welfare of the public? and <br />WHEREAS, Jacquelynn M. Kelly (hereinafter "the <br />applicant") is the owner of the property located at 2056 <br />Shadywood Road within the City of Orono (hereinafter "the City ) <br />and legally described as follows: <br />The southerly half of Lot 7* and all of Lot 8, Gust S. <br />Johnson's Addition, Hennepin County, Minnesota according to <br />the recorded plat thereof, Hennepin County, Minnesota <br />* For the purpose of this survey, the north line of the <br />southerly half of Lot 7 has been assumed to be a straight <br />line drawn from the mid-point of the southwesterly line of <br />said Lot 7 through the mid-point of the survey line near the <br />northeasterly line of said Lot 7, as shown on the recorded <br />plat of Gust S. Johnson's Addition, said north line of the <br />southerly half of said Lot 7 being extended to the shoreline <br />of Lake Minnetonka (hereinafter "the property")? and <br />WHEREAS, the applicant has applied to the City of Orono <br />for after-the-fact variances to Municipal Zoning Code Section <br />10.22, Subdivisions 1 (B) & 2 to permit a deck to be installed 4' <br />in front of the average lakeshore setback for the property and a <br />hardcover variance within the 75-250' setback area resulting in <br />6,140.45 s.f. or 49% where only 3,161.25 s.f. or 25% is allowed; <br />and <br />WHEREAS, the City Council has considered this <br />application including the findings and recommendation of the <br />Planning Commission, reports by City staff and to written and <br />verbal comments of the applicant and the applicant's attorney. <br />NOW, THEREFORE, BE IT RESOLVED that the City Council of <br />Orono, Minnesota hereby denies the application of Jacquelynn M. <br />Page 1 of 6
