Mabusth, Building & Zoning Administrator <br />December 3, 1990 • <br />#1334 Rebers Construction, Inc. - Sugarwoods PRD - <br />Adoption of Review Procedure for Nonconforming Lots <br />Resolution <br />Ir: <br />■I- <br />List of Exhibits <br />Exhibit A - Council Minutes of 10/22/90 <br />Exhibit B - Option A - Resolution <br />Exhibit C - Option B - Resolution <br />Rexiew of Current Application - <br />At the October 22, 1990 meeting of the Council (review <br />Exhibit A), members failed to achieve a majority vote adopting a <br />review procedure for all requests that exceed allowed driveway <br />isq>rovement within the front setback area of the Sugarwoods PRD. <br />At Council's November ;:h meeting, Stephen Pflaum advised <br />that he had presented an abu-aviated review procedure b^tore the <br />Planning Commission that would designate the Planning Cuounission <br />as the sole reviewing body for such requests with the right of <br />each builder/o«mer to appeal before the Council all decisions of <br />the Planning Commission. Please review the minutes of the <br />Novesiber 19th Planning Commission meeting Included within your <br />Council packets. Planning Commission members voiced no concern <br />with the recommended process set forth by Pflaum. Above all, the <br />Planning Commission wants to preserve its rights to be a part of <br />the review process for all requests that involve any variation <br />from the standards set forth in the original resolution approving <br />the Sugarwoods PRD. <br />Staff has enclosed two resolutions that establish review <br />procedures for all nonjonforming lots within the PRD. Exhibit B <br />or Option A sets fovth the established or customary review <br />process used for all land use applications (review and <br />recomsMndation by Planning Commission and referral to Council for <br />final/formal action). Option B, Exhibit C, sets forth an <br />abbreviated review procedure whereby the Planning Commission will <br />be the sole reviewing body with the right of appeal before the <br />Council for all decisions of the Planning Commission. <br />Comioil Action <br />Adoption of either Option A or Option B. <br />Isv
