A RESOLUTION GRANTING <br />VARIANCES TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.22, SUBDIVISIONS 1 (B) 6 2 <br />PILE #1602 <br />(hereinafter theWHEREAS, Don W. Copley <br />applicant") is the owner of the property located at 1185 Tonkawa Road <br />within the City of Orono (hereinafter "City") and legally described as <br />Tract B, Registered Land Survey #853, Hennepin County, Minnesota <br />(hereinafter "the property"); and <br />WHEREAS, the applicant has applied to the City for <br />a variance to Municipal Zoning Code Section 10.22, Subdivision 1 (B) <br />to allow construction of an addition to the existing residence located <br />1-1/2' in front of the average lakeshore setback line and a variance <br />to Section 10.22, Subdivision 2 seeking approval of a hardcover <br />variance within the 75-250' setback area of 1.22 square feet or .5% <br />over the allowed haracover of 5,707 square feet or 25%. <br />Minnesota ; <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. This application was reviewed as Zoning File #1602. <br />2. The property is located in the LR-IB Single Family Lakeshore <br />Residential Zoning District requiring 1 acre in area. The <br />property consists of 28,405 square feet or .65 acres. <br />3. The Orono Planning Commission reviewed this renewal <br />application on November 19, 1990 and recommended approval of the <br />average lakeshore setback variance and hardcover variance of .5% <br />based cn the following findings; <br />A) The encroachment of the average lakeshore setback is <br />minimal at 1-1/2' and will have no negative impact on the <br />lake views of the adjacent residences. <br />B) There is no hardcover in the 0-75' setback area on the <br />property. <br />C) The proposed total area or size of the residence <br />structure is consistent with the size and area of <br />surrounding residences on adjacent lots of similar size. <br />Page 1 of 4
