City Attorney advised that the City could not approve <br />the proposed use because the use was commercial and <br />would be in violation of both Orono code and S^ate Law. <br />The City would have to rezone <he property to <br />commercial. The City denied the request. <br />B) 1955 Shoreline Drive is zoned lakeshore commercial. <br />The City approved variances for the construction of a <br />new clubiouse and other site improvements. <br />C) 1960 Shoreline Drive, a residential zoned property, <br />had an established legal non-conforming use, gas sales <br />and auto repair. Based on the findings already noted <br />in this resolution, the City approved a boat <br />sales/nautical shop use. The City specifically granted <br />approval of this use because there was to be no <br />specific connection to the marina use on the east side <br />of County Road 15 and no service of boats because <br />the physical limitation o. che property. <br />It was clear throughout the review that the props : I960 <br />Shoreline Drive had no connection with the operatr.^n of the <br />Marina at 1955 Shoreline Drive. File #1112 is hereby <br />referenced to confirm this finding. <br />22. On January 29, 1990, the applicant filed a conditional <br />use permit to permit boat .sales and service use at property <br />located at 1960 Shoreline Drive (Orono File #1497). The <br />current application involvuj an expansion with the servicing <br />of boats. This use was specifically denied in the review of <br />Application #1112 because of the limited size of the <br />property. <br />23. On March 19, 1990, the Planning Commission voted (3 <br />ayes, 1 abstention) to recommend approval of a conditional <br />use permit to allow the property located at 1960 Shoreline <br />Page 7 of 13
