<br />MCWD's Wetland Protection Rule is triggered when work is proposed within a wetland, and/or when <br />impervious surfaces are created upgradient of wetlands on site. The Wetland Protection Rule requires <br />the establishment of wetland buffers, the width of which is determined by the wetland's management <br />classification. To meet MCWD’s Wetland Protection rule requirements, please address the following <br />items: <br />• Proposed site plans with: <br />o Proposed grading and other disturbance in wetland or buffer <br />o Proposed wetland buffer sign locations (must be at all lot lines and spaced less than 100 <br />feet apart) <br />o If buffer averaging is proposed, calculation of required and provided buffer area and <br />indication of the minimum, maximum, and average widths on the site plans. <br />o If excavating in the wetland, proposed location of spoils placements and specifications <br />to stabilize and vegetate spoils <br />• Wetland buffer vegetation plan (if the buffer is not currently vegetated or will be disturbed by <br />construction): <br />o Description of seed and plant materials, including supplier and origin <br />o Seed/planting bed preparation (ex. Clearing, disking, raking, herbicide control, soil <br />amendment, or addition) <br />o Seeding/planting method <br />o Application rate of seeds or plugs (pounds of seed per acre or plants per unit area) <br />o Measures for site protection and erosion prevention during establishment <br />o An inspection and maintenance schedule describing activities (ex. Watering, mowing, <br />invasive species control, herbicide application, burning, etc.) for five years of <br />establishment <br />o The criteria for buffer vegetation establishment <br /> <br />Stormwater Management Rule <br />MCWD’s Stormwater Management Rule is triggered by the creation of new or replacement of existing <br />impervious surface. <br /> <br />Development – greater than 1 acre <br />The Project proposes development on a site that is greater than one acre in size, has 1.88 acres of <br />new/fully reconstructed impervious area, will disturb 29.33% of the site, and has an impervious surface <br />change of 241%; therefore, the rule is triggered. The required treatment scope is the volume from the <br />entire site’s impervious surface and rate control. <br /> <br />To meet MCWD’s Stormwater Management rule requirements, please address the following items: <br />o The SWMP states that not all of the proposed impervious can be captured and routed to <br />a stormwater basin. Outline the amount of impervious that cannot be caught and <br />routed to a basin. Please update the design to capture additional on-site impervious to <br />the maximum extent feasible. <br /> If it is not feasible to capture additional on-site impervious, an equivalent <br />amount of off-site impervious surface that is untreated in the existing condition <br />may be captured. <br />156
