6 <br />SECTION 1 <br />DEFINITIONS <br />The following words when used in the Governing Documents shall have the following meanings (unless <br />the context indicates otherwise): <br /> <br />1.1 “Act” means the Minnesota Common Interest Ownership Act, Minnesota Statutes Chapter <br />515B, as amended. <br /> <br />1.2 "Additional Real Estate" means the real property legally described on Exhibit C attached <br />hereto, including any improvement located thereon now or in the future, and all easements and <br />rights appurtenant thereto, which property Declarant has the exclusive right to add to the <br />common interest community. <br /> <br />1.3 “Assessments” means and refers to all assessments levied by the Association pursuant to <br />Section 6 of this Declaration. <br /> <br />1.4 “Association” means Orono Garage Condominium Association, a nonprofit corporation <br />created pursuant to Minnesota Statutes Chapter 317A and Section 515B.3-101 of the Act, <br />whose members consist of all Owners. <br /> <br />1.5 “Board” means the Board of Directors of the Association, as provided for in the Bylaws. <br /> <br />1.6 “Building” means each structure which is or becomes a part of the Property and contains a Unit <br />or Units. <br /> <br />1.7 “Bylaws” means the Bylaws governing the operation of the Association, as amended from time <br />to time. <br /> <br />1.8 “City” means the city of Orono, Minnesota. <br /> <br />1.9 “Common Elements” means all parts of the Property including any improvement thereon, <br />except the Units. <br /> <br />1.10 “Common Expenses” means all expenditures made or liabilities incurred by or on behalf of <br />the Association and incident to its operation, including Assessments and items otherwise <br />identified as Common Expenses in the Declaration or Bylaws. <br /> <br />1.11 “Common Interest Community” (also sometimes referred to herein as “CIC”) shall mean the <br />contiguous or noncontiguous real estate described on Exhibit B attached hereto that is subject <br />to this Declaration, as more fully described in Section 515B.1-103(10) of the Act. <br /> <br />1.12 “Declarant Control Period” means the time period during which Declarant has the exclusive <br />right to appoint the members of the Board, as described in Section 14.7 of this Declaration. <br /> <br />1.13 “Governing Documents” means this Declaration, and the Articles of Incorporation and <br />Bylaws of the Association, as amended from time to time, all of which shall govern the use and <br />operation of the Property. <br /> <br />1.14 “Limited Common Elements” means a portion of the Common Elements allocated by the <br />Declaration or by operation of Section 515B.2-102(d) of the Act for the exclusive use of one <br />or more but fewer than all of the Units. <br /> <br />54
