Hamm Dated October 10, 1995” (hereinafter “The Trust”) <br /> <br />485 Orono Orchard Road South <br />Subdivision/Preliminary Plat: “Sky Blue Waters” + Termination of Document No. 7285795 <br />Public Hearing <br /> <br /> <br />PRELIMINARY PLAT REVIEW <br /> <br />General Site Characteristics <br />The applicant is requesting preliminary plat approval to <br />create one new 2+ acre buildable lot. The existing <br />property is approximately 21.3 acres along Orono <br />Orchard Road South, most of the land is situated north of <br />Fox Street. <br /> <br />The property is made up of rolling hills, wooded areas, <br />and wetlands; it contains numerous gardens, walking <br />paths, building improvements including a home, guest <br />house, and two barns. The property is currently served by <br />City sewer. All of the existing improvements are proposed <br />to remain. A wetland delineation has been completed <br />and the wetlands have been depicted on the preliminary <br />plat drawing with the Minnehaha Creek Watershed <br />District (“MCWD”)-required buffers are shown. <br /> <br />The wetland delineation, attached as Exhibit F, was <br />approved by the MCWD in August of 2021. The MCWD’s <br />approval or Notice of Decision is attached as Appendix B <br />of the Conservation Design Report, attached as Exhibit E. <br /> <br />Conformity with RR-1B Zoning District Standards <br />The property is zoned RR-1B One Family Rural Residential <br />requiring a minimum of two (2) acres per lot. The newly created parcels will conform to the current zoning district <br />standards relating to size and width. The existing buildings and improvements on the northern lot, Lot 1, Block 1 (or <br />“L1B1”) are proposed to remain following the Final Plat; proposed Lot 1, Block 2 (or “L1B2”) south of Fox Street is <br />currently vacant. New buildings must meet the required zoning district standards as no variances have been <br />requested. The properties are within the MUSA and are proposed to be served by City sewer. <br /> <br /> <br />Application Summary: Consider preliminary plat approval to create one additional buildable lot and termination <br />of an existing covenant limiting development based on sewer connections. <br />Staff Recommendation: Staff recommends approval. <br />283
