17. In a letter dated August 16, 1990, James H. Gilbert, <br />applicant’s attorney, notes as follows: <br />"My client will never concede that there has been a <br />lapse of commercial use on this property. There is no <br />fi§l <br />been a continual use of this property for commercial <br />purposes related to the Marina business. This has <br />included, but has not been limited to, the storing of <br />property, the conducting of meetings, the storage o^ <br />boats and other Marina equipment, sales and leasing <br />efforts relating to the Marina property and other <br />miscellaneous commercial work. <br />18. If the uses noted in Mr. Gilbert's letter of August 16, <br />1990 took place on the property, the applicant knew he was <br />violating the non-conforming use sections of the Orono <br />Municipal Cede. Any of the uses described in Mr. Gilbert's <br />letter would have required the applicant to seek a new <br />conditional use permit. <br />19. Mr. Gilbert's letter of August ^6, 1990 goes on to <br />note: <br />". . .this property is an integral part of the Marina". <br />20. Prior to 1987, the properties located at 1955 Shoreline <br />Drive and 1960 Shoreline Drive were under separate <br />ownership. In 1987, the applicant acquired both properties. <br />Historically, there has never been a connection between the <br />properties either in use or ownership. It should be noted <br />that 1960 Shoreline Drive and 1955 Shoreline Drive are <br />divided by County Road 15. 1960 Shoreline Drive is zoned <br />LR-IA lakeshore residential and 1955 Shoreline Drive is <br />zoned B-2 lakeshore commercial. <br />21. In 1987, Application #1112 was filed by the applicant <br />and involved a comprehensive land use review th.-*t included <br />three properties purchased by the applicant within the <br />Crystal Bay neighborhood; 1950, 1955 and 1960 Shoreline <br />Drive.
