2.6. Benefits. Any disbursement or reimbursement provided to or on <br />behalf of the employee under the terms and conditions of this plan. <br />2.7. Code. The Internal Revenue code of 1986, as amended. Reference <br />to any section or subsection of the code includes reference to any <br />amending or replacing provisions of any legislation or regulation. <br />The reference may also include the Employee Retirement Income Security <br />Act of 1974 (ERISA), as amended, and any other applicable Federal or <br />State legislation or regulation. <br />2.8. Company. The company named in the Adoption Agreement, also <br />referred to as we, us or our(s). <br />2.9. Compensation. The total earnings actually paid to an employee <br />by us. This includes over-time pay, scheduled bonuses, and <br />commissions, but excludes expense allowances and any other <br />extraordinary compensation. <br />2.10. Dependent. The term "Dependent” shall have the same meaning as <br />set out in Section 152 of the Code. In addition, for purposes of this <br />plan, it means any individual for whom the participant is entitled to <br />claim an exemption under Section 151(c) of the Code, <br />2.11. Dependent Care. Within the meaning of Code Section 129, <br />Dependent Care shall mean household and employment related services <br />and expenses incurred by a Participant which: <br />(a) are incurred for the care of a qualifying individual within the <br />meaning of the Code Section 21(b), <br />(b) are performed to enable a Participant to remain gainfully <br />employed, and <br />(c) are incurred for the care of dependents in a dependent care <br />service provider pursuant to employment-related expenses under Code <br />Section 129. <br />2.12. Dependent Care Service Provider. Dependent Care Service <br />Provider means a person who provides care or other services described <br />in Section 2.11 above, but shall not include (a) a dependent care <br />center (as defined in Section 21(b)(2)(D) of the Code), unless the <br />requirements of Code Section 21(b)(2)(C) are satisfied, or (b) a <br />related individual described in Section 129(c) of the Code. <br />2.13. Disability. The definition of "disability" will vary, <br />depending upon the benefit claimed. The statutory or contract <br />definition provided in the governing contract or statute shall apply <br />to the exclusio'* of any other definition. <br />2.14. Earned Income. All income derived from wages, salaried, tips, <br />and other employee compensation paid to an employee during the Plan <br />Year. Such income does not include any amounts paid or incurred (i)
