s - 0 CITY of ORONO RESOLUTION OF THE CITY COUNCIL NO. 5474 - A RESOLUTION GRANTING LOT WIDTH AND LOT AREA VARIANCES TO MUNICIPAL ZONING CODE SECTION 78-330 FILE NO. 06-3192 WHEREAS, William Titler and Mary K. Titler, husband and wife (hereinafter "the owners") are the owners of the property located at 4209 North Shore Drive within the City of Orono (hereinafter the "City") and legally described as follows: That part of Lot 2, Orchard Beach, Hennepin County, Minnesota, described as follows: Beginning at a point on the North line of said Lot 2 a distance of 98 feet Southeasterly from the Northwesterly corner of said Lot 2; thence Southwesterly to a point on the Southerly line of said Lot 2 which point is 60 Is feet Southeasterly from the Southwesterly corner of said Lot 2; thence Southeasterly along the Southerly line of Lot 2 a distance of 60 feet; thence Northeasterly to the Northerly line of said Lot 2 to a point on said line which point is 76.5 feet Southeasterly along the Northerly line of said Lot from the point of beginning; thence Northwesterly along the Northerly line of said lot to the point of beginning (hereinafter the "property"); and WHEREAS, the owners have made application to the City of Orono for variances to Orono Municipal Zoning Code Section 78-330 to allow construction of a house on a lot that is 55 feet wide when 140 feet is required and has an area of .58 acre when one acre is required. WHEREAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning Commission held a public hearing on May 15, 2006, at which time all persons desiring to be heard concerning this application were given the opportunity to speak thereon.
