RESOLUTION OF THE CITY COUNCIL <br /> `�kES8o-- NO. 5 4 T 1. <br /> A RESOLUTION GRANTING HARDCOVER, LOT WIDTH <br /> AND LOT AREA VARIANCES TO MUNICIPAL ZONING CODE <br /> SECTION 78-350 AND SECTION 78-1288 <br /> AND <br /> A CONDITIONAL USE PERMIT FOR LAND ALTERATIONS <br /> WITHIN THE 0—75 FOOT SHORELAND ZONE PER SECTION 78-966 <br /> FILE NO. 06-3197 <br /> WHEREAS, Paul S. Hanssen and Leann M. Hanssen, husband and wife <br /> (hereinafter "the owners") are the owners of the property located at 2445 Dunwoody Avenue <br /> within the City of Orono (hereinafter the "City") and legally described as follows: <br /> The Southeasterly 1/2 of Lot 4, Block 8, Townsite of Langdon Park, Hennepin County, <br /> Minnesota, the intent being to convey that portion of said Lot 4 bounded, as follows: Beginning <br /> at the Southeasterly corner of said Lot 4 and running thence 62 1/2 feet Northwesterly along the <br /> Easterly boundary line of said Lot 4, thence Southwesterly and parallel to the Southerly <br /> boundary line of said Lot 4 to the lakeshore; thence Southeasterly along the lakeshore 62 1/2 feet <br /> to the Southwesterly corner of said Lot 4 and thence Northeasterly along said Southerly <br /> boundary line of said Lot 4 to the place of beginning, according to the map or plat thereof on <br /> file and of record in the office of the Register of Deeds in and for said County of Hennepin, <br /> State of Minnesota(hereinafter the"property"); and <br /> WHEREAS, the owners have made application to the City of Orono for <br /> variances to Orono Municipal Zoning Code Section 78-350 to allow construction of a house <br /> on a lot that is 62.5 feet wide when 100 feet is required and has an area of.38 acre when .5 <br /> acre is required. <br /> WHEREAS, the owners have made application to the City of Orono for <br /> variances to Orono Municipal Zoning Code Section 78-1228 to allow 29.4 percent hardcover <br /> in the 75-250 foot shoreland zone when 25 percent would be allowed. <br /> WHEREAS, the owners have made application to the City of Orono for a <br /> conditional use permit per Orono Municipal Zoning Code Section 78-966 to allow grading <br /> within the 0-75 foot shoreland zone. <br /> WHEREAS, after due published notice and mailed notice in accordance with <br /> Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br /> Page 1 of 6 <br />
