�o� <br /> _ o 0 <br /> - C ITY of ORONO <br /> . � :- � <br /> ti <br /> ti <br /> RESOLUTION OF THE CITY COUNCIL <br /> ��`9kESII04�G NO. <br /> be located 50' from the OHWL of Lake Minnetonka where a 75' setback is normally required; <br /> and Section 78-1288 to allow 987 s.f. or 24.39% hardcover within the 0-75' zone and 1,494 s.f. <br /> or 36.16% hardcover within the 75'-250' zone where 0% and 25% respectively are normally <br /> allowed; and a conditional use permit pursuant to Zoning Code Sections 78-1116 and 78-1117 in <br /> order to conduct land alterations below 931.5' MSL or the 100-year floodplain elevation in <br /> conjunction with the construction of a new home. <br /> 1. Council approval is based on the site plan submitted by the applicant and annotated by <br /> City staff, attached to this Resolution as Exhibit A. Any amendments to the site plan <br /> which are not in conformity with City codes will require further Planning Commission <br /> and City Council review. <br /> 2. Hardcover in the 0-75' zone shall not increase above the level of 987 s.f. or 24.39%. <br /> Hardcover in the 75-250' zone shall be limited to 1,494 s.f. or 36.13% per the proposed <br /> plan and hardcover allowance summary as depicted on Exhibit A. Applicant is advised <br /> that any future requests to increase hardcover or change the nature of existing/approved <br /> hardcover shall require City approval, and increases in hardcover will not likely be <br /> approved without concurrent reduction in existing hardcover. <br /> 3. Applicant shall remove all plastic or fabric liner material from the decorative landscape <br /> beds on the property to ensure their permeability as non-hardcover surfaces. <br /> 4. Required removals of structure and hardcover shall be completed by the footing <br /> inspection for the new home. <br /> 5. Approval from the Minnehaha Creek Watershed District is required for the land <br /> alterations below the elevation of 931.5' prior to the issuance of a building permit. <br /> 6. The lowest floor of the house shall be established no lower than the Regulatory Flood <br /> Protection Elevation of 932.5' MSL. <br /> 7. Prior to building permit issuance, the applicant shall verify site elevations and grading <br /> and drainage information to satisfy the City Engineer that the elevations obtained under <br /> winter conditions are reflective of actual site conditions and that all drainage shall be <br /> handled in a manner that will not cause drainage problems for this residence or the <br /> neighborhood. <br /> Page 4 of 6 <br />
