• <br />• <br />CITYof ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 54 34 <br />A RESOLUTION APPROVING THE <br />PRELIMINARY PLAT FOR PROPERTY LOCATED AT <br />3805 & 3845 NORTH SHORE DRIVE AND 1635 SHADYWOOD ROAD <br />FILE NO. 05-3161 <br />WHEREAS, Loren R. Fritz (hereinafter the "Developer") is owner of the <br />properties within the City of Orono (hereinafter the "City") located at 3805 & 3845 North Shore <br />Drive and 1635 Shadywood Road, legally described as follows: <br />Exhibit A, attached <br />(hereinafter the "Property"); and <br />WHEREAS, on October 19, 2005 the Developer filed a formal subdivision <br />application with the City for preliminary approval of a five -lot residential plat of the Property; <br />and <br />WHEREAS, after due published and mailed notice in accordance with Minnesota <br />Statutes 462.358 et. seq. and the City of Orono Zoning and Subdivision. Codes, the Orono <br />Planning Commission held public hearings on November 21, 2005 and on February 21, 2006 at <br />which times all persons desiring to be heard concerning this application were given the <br />opportunity to speak thereon; and <br />WHEREAS, at its regular meeting of February 27, 2006 the Orono City Council <br />considered the subdivision application of the Developer; and <br />WHEREAS, the City Council hereby makes the following findings in regard to <br />this application: <br />FINDINGS <br />1. This application was reviewed as Zoning File #05-3161. <br />2. The property is zoned LR -1C Single Family Lakeshore Residential District, <br />which requires a minimum lot area of 0.5 acres and minimum lot width of 100'. <br />The Property is 3.87 acres in area, of which 0.09 acres is wetland and 3.78 acres is <br />non -wetland area. Each proposed lot meets or exceeds the 0.50 acre minimum <br />with the two proposed back lots meeting or exceeding the 0.75 acre minimum. <br />Page 1 of 9 <br />
