COUNCIL <br />NO. -.54 1 0 <br />A RESOLUTION GRANTING VARIANCES <br />AND A CONDITIONAL USE PERMIT <br />PER MUNICIPAL ZONING CODE <br />SECTION 78-418 (1) <br />FILE NO. 05-3139 <br />WHEREAS, Hill School of Minnesota, Inc., a Minnesota non-profit <br />corporation (hereinafter "the applicant") is the owner of the property located at 2180 <br />North Shore Drive within the City of Orono (hereinafter the "City") and legally described <br />as follows: <br />Lots 5 and that part of Lots 4 and 6, lying East of the West 69 feet thereof, Block <br />3, Markville, Hennepin County, Minnesota <br />(hereinafter the "property"); and <br />WHEREAS, the applicant has made application to the City of Orono for <br />side yard and side street yard setback variances and a conditional use permit per Orono <br />Municipal Zoning Code Section 78-418 (1) to permit construction of an addition to the <br />north of the existing building to be located less than 50' fiom the western side yard and <br />street yard of Briar Street when 50' is normally required. <br />NOW, THEREFORE DE IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File 05-3139. <br />2. The property is located in the RR — 1B, Zoning District which requires a <br />minimum lot area of 2.0 acres and a minimum lot width of 200'. The <br />property contains 0.58 acres of area and 106' of defined lot width. <br />3. The Planning Commission reviewed this application at a public hearing <br />held on November 21, 2005 and recommended approval of the variances <br />and conditional use permit based on the following findings: <br />Page 1 of 5 <br />
