No. 5 5 8 A <br /> A RESOLUTION GRANTING VARIANCES <br /> TO MUNICIPAL ZONING CODE <br /> SECTION 78-1405 SUBDIVISION 7 <br /> FILE NO. 07-3260 <br /> WHEREAS, Roger D. O'Shaughnessy, a single person (hereinafter "the <br /> applicant") is the owner of the property located at 1265 Bracketts Point Road within the City of <br /> Orono (hereinafter the "City") and legally described as follows: <br /> Attached as Exhibit A, Hennepin County, Minnesota (hereinafter the "property"); <br /> and <br /> WHEREAS, the applicant has made application to the City of Orono for an after- <br /> the-fact variance to Orono Municipal Zoning Code Section 78-1405 (7) to allow construction of <br /> a fence 60" in height where 42"maximum height is permitted. <br /> NOW, THEREFORE BE IT RESOLVED by the City Council of <br /> Orono, Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File 07-3260. <br /> 2. The property is located in the LR — 1A Lakeshore Residential Zoning District <br /> which requires a minimum lot area of 2.0 acres and a minimum lot width of 200'. <br /> 3. The Planning Commission reviewed this application at a public hearing held on <br /> January 16, 2007 and recommended approval of the fence height variance based <br /> on the following findings: <br /> a. The applicant's property is a corner lakeshore lot abutting County Road 15 as <br /> well as Bracketts Point Road. The code language regarding fences along <br /> roadways for corner lakeshore lots abutting a major thoroughfare and a local <br /> street is ambiguous. <br /> b. The wrought iron fence is not out of character with the neighborhood. <br /> Page 1 of 4 <br />
