The Planning Commission reviewed this application on September 18, 2006 <br /> and on a vote of 5 - 1 recommended conditional approval of the variances <br /> subject to revising�the semi-circular portion of the addition to meet the ten foot <br /> required side setback,based on the following findings: <br /> a. The Owners agreed to not construct the previously approved deck outside <br /> the footprint of the addition. This would result in a substantial reduction in <br /> the amount of previously approved hardcover in the 75 to 250 foot zone. <br /> b. The houses fo each side of the Property are closer to the lake than the house <br /> on the Property. The house on the northwest side is located entirely <br /> forward of the house on the Property. The addition would not intrude of <br /> • the lakeshore views of these properties and would enhance the lakeshore <br /> views of the Property. <br /> . � c. The Owners agreed to revise the semi-circular portion of the addition to <br /> meet the ten foot side setback. The side setback variance �llows minimal <br /> extension of the existing sidewall of the house. The original house was <br /> constructed before zoning regulations were adopted. <br /> 4. The City Council has considered this application including the findings and <br /> recommendation of the Planning Commission, reports by City staff, comments <br /> by the applicants and the public, and the effect of the proposed variance on the <br /> health, safety and welfare of the community. <br /> 5. The City Council finds that the conditions existing on this property are peculiar <br /> to it and do not apply generally to other property in this zoning district; that <br /> granting the variances would not adversely affect traffic conditions, light, air <br /> nor pose a fire hazard or other danger to neighboring property; would not <br /> merely serve as a convenience to the Owners, but are necessary to alleviate a <br /> demonstrable hardship or difficulty; are necessary to preserve a substantial <br /> property right of the Owners; and would be in keeping with the spirit and <br /> intent of the Zoning Code and Comprehensive Plan of the City. <br /> • <br /> .
